This book is a collection of secondary essays on America's most important philosophic thinkers—statesmen, judges, writers, educators, and activists—from the colonial period to the present. Each essay is a comprehensive introduction to the thought of a noted American on the fundamental meaning of the American regime.

This paper is a contribution to the discussion of how religious perspectives can improve business ethics. Two such perspectives are in natural law of antiquity and recent Catholic social doctrine and teaching. This paper develops a conceptual framework from natural law and CSD/T that business leaders can adopt to build an ethos of humanistic management. This “Human Dignity-Centered” framework fills the gap between time-tested Christian norms and contemporary firm-leaders’ concrete needs. “Human dignity” is used as a rhetorical device to convey (...) the idea that firms are composed of dynamic social networks, with an ultimate purpose of serving human needs. Ultimately, the principles and virtues the framework employs have a logic that should inspire excellence, as ethical practices and concern for human welfare lay a foundation for long-term business prosperity. In a one-frame visual representation, this paper portrays: firm leadership challenges; a transforming ethical prism of principles and virtues; and results and feedback mechanisms. The accompanying narrative describes each element and how each affects humanistic management. Finally, illustrative company examples and questions are provided to illustrate how the framework can be used to benefit human flourishing. Property and contract rights are not defined a priori, but should be defined in a way that they will, as a practice, do the best job of equitably promoting life prospects. The chapter uses the main principle to explain the moral appropriateness of the contours of property rights (...) to both tangible and intangible property; exceptions to contracts, including unconscionability, implied warranties, strict liability, mandatory disclosure, bankruptcy; the replacement of caveat emptor with caveat venditor in win-win contracts; market economies; negative income tax; voluntary consent to economic and other transactions; prohibitions on slavery contracts; minimum wage legislation. The chapter contrasts his account with fair starting-point theories of justice, including Ronald Dworkin’s theory. ConnellOne of the more unusual works in the corpus of the Italian humanist Lorenzo Valla is the Oratio in principio sui studii, on the relation between Latin letters and the Christian faith. The speech was written and delivered in October 1455, toward the end of Valla’s life, as a lecture to inaugurate the academic year at the University of Rome where he had held the chair in (...) rhetoric since 1450. It was traditional at Rome to hold such an address each year not only to encourage the assembled students and faculty in their studies but also to thank the papacy for its support of the university, the Studium Urbis. For this reason Valla’s speech ends with customary words praising Pope Calixtus III for having increased the stipends of the lecturers in the university, even though, notwithstanding some remarkable kindnesses to Valla himself, Calixtus’s reputation was not that of a friend to scholarship. Valla’s Schoolyear Inaugural was not lengthy: it can only have lasted fifteen minutes. Nor is there indication that anyone was displeased with it. In fact, that is precisely what is oddest about the Inaugural, for throughout his career Valla had shown himself to be the sort of person who seized on such occasions to make polemical arguments. We read the speech—and it is possible that his audience also listened to it this way—expecting with each step that Valla will let fly a critical or unorthodox statement, but that never happens. 1Beginning with his earliest formal work, a comparison of Cicero and Quintilian written in 1428 and now lost, in which the humanist argued against Cicero on behalf of Quintilian, Valla seemed to delight in challenging established authorities. 2 His next important work, an attack on Bartolus of [End Page 1] Sassoferrato and the scholastic method of contemporary jurists, resulted in his forced departure from the University of Pavia. 3 A continuing combativeness is illustrated in subsequent writings, reaching an apogee in the work on the Donation. Even when Valla was developing another writer’s idea, he had a consistent way of pushing the argument to a daring extreme. This, as Riccardo Fubini argues below, is what Valla did in the De donatione, a work Fubini suggests relied more heavily on Nicholas of Cusa’s De concordantia catholica than hitherto realized, but written to promote an agenda far more radical than that of Cusanus. One of the surest indications of Valla’s brilliance as a polemicist is the fact that seventy years after his death humanists of the caliber of Agostino Steuco, the subject of Ronald K. Delph’s essay in this number, were still eager to take up cudgels against him.Valla paid a price for initiating so many disputes. In 1444, when he was called before the Inquisition in Naples after the attack on the Donation of Constantine, Valla was made to answer charges against not only that work, but also against the De vero bono for its Epicureanism, the De libero arbitrio for its determinism, the De professione religiosorum for its criticism of religious orders, and the Repastinatio totius dialectice et philosophie for various unorthodox statements, especially concerning the Trinity. This last work was the humanist’s most ambitious project, and he seems to have been aware of its explosive quality, since he alluded to a “peril to his life” should it be published. 4The 1455 Schoolyear Inaugural shows no trace of the risks that Valla took in his other writings, of his polemical temperament, or of his past disagreements with the Church. With style and vigor the speech argues that the Church deserves great thanks and praise for having ensured the survival [End Page 2] of Latin letters after the collapse of the Empire. This may seem a notable change of heart in the author who had written the oration On the Falsely Believed and Forged Donation of Constantin—a text which always seems to be lurking in the background of the Inaugural but which finds no explicit reference there. Responding to volatile criticisms frequently leveled at Leo Strauss and those he influenced, the prominent contributors to this volume demonstrate the profound influence that Strauss and his students have exerted on American liberal democracy and contemporary political thought. By stressing the enduring vitality of classic books and by articulating the theoretical and practical flaws of relativism and historicism, the contributors argue that Strauss and the Straussians have identified fundamental crises of modernity and liberal democracy.

Ronald Preston defended the middle axiom approach to doing Christian social ethics developed by J. H. Oldham for the 1937 ‘Life and Work’ conference. Preston argued that middle axioms continue to offer the churches a relevant ecumenical method. Middle axions has since been subject to fundamental criticism by ethicists such as Duncan Forrester. It will be argued that a case study of the Church of Scotland's contribution to the devolution debate, as part of Scottish civil society, supports Preston's defence (...) of the middle axiom approach as a relevant form of political engagement in the new context of local-global politics. On 18–19 May 2018, a symposium was held in the Research Institute of Irish and Scottish Studies at the University of Aberdeen to commemorate the tenth anniversary of the death of Ronald W. Hepburn (1927–2008). The speakers at this event discussed Hepburn’s oeuvre from several perspectives. For this book, the collection of the revised versions of their talks has been supplemented by the papers of other scholars who were unable to attend the symposium itself. Thus this volume contains contributions (...) from eighteen notable scholars of different disciplines, ranging from contemporary aesthetics and art theory through to philosophical approaches to religion, education and social anthropology. It also includes a bibliography of Hepburn’s writings. The essays were first published in two special issues of the Journal of Scottish Thought, vols. 10–11 (2018–2019). -/- Ronald William Hepburn was born in Aberdeen on 16 March 1927. He went to Aberdeen Grammar School, then he graduated with an M.A. in Philosophy (1951) and obtained his doctorate from the University of Aberdeen (1955). His tutor at Aberdeen was Donald MacKinnon (1913– 1994), a Scottish philosopher and theologian, the author of A Study in Ethical Theory (1957) and The Problem of Metaphysics (1974). Hepburn taught as Lecturer at the Department of Moral Philosophy at Aberdeen (1956–60), and he was also Visiting Associate Professor of Philosophy at New York University (1959–60). He returned from the United States as Professor of Philosophy at Nottingham University. In 1964, he was appointed as a Chair in Philosophy at the University of Edinburgh and between 1965 and 1968 he was also Stanton Lecturer in the Philosophy of Religion at the University of Cambridge. From 1975 until his retirement in 1996, he held the Professorship of Moral Philosophy at Edinburgh. He died in Edinburgh on 23 December 2008. His philosophical interests ranged from theology and the philosophy of religion through moral philosophy and the philosophy of education to art theory and aesthetics. Notably, Hepburn is widely regarded as the founder of modern environmental and everyday aesthetics as a result of the influence of papers in the 1960s which pioneered a new approach to the aesthetics of the natural world. The editors tell us at the outset of this important volume that it is the outcome of two convictions that they share: (1) "that the interaction of science and Christianity has been of profound imp@tance in the shaping of Western civilization" and (2) that the results of extensive specialist work by historians of science and religion in recent decades belie widelyheld stereotypes and ought to be made generally available. The most familiar of the stereotypes is of course the Draper-White 66 warfare" thesis, the origins and continuing influence of which the editors trace in the first part of their helpful introduction. The eighteen contributors to the volume find plenty of controversies-sometimes rising to the level of conflicts-among individuals, among theological schools of thought, among scientific schools of thought, and among social groups, but at no period do they find anything that could be called an overall conflict of science and theology. They find many instances of smallerand larger-scale influences of theological developments on scientific ones, of scientific developments on theological ones, and of social developments on both. But no grand overall interpretative scheme appears in this respect either. Stanley L. Jaki's thesis, for instance, that modern science BOOK REVIEWS 563 was born of Christian theology and has prospered just insofar as it has remained faithful to its parentage, fares no better than the warfare thesis. No sweeping unitary interpretation can be expected to emerge, Lindberg and Numbers sugg.est, from historical work that " shows the respect for the particularity, individuality and value of each people and age that the canons of historical scholarship demand" (p. 10; i:r).ternal quotation from Donald Kagan). Accordingly, each essay is devoted to a particular period-some longer than others, to be sure. Nearly all are by professional historians. One author is primarily a philosopher, and several have at least secondary philosophical interests ; none are primarily scientists or theologians. Nearly all were trained and teach at secular universities, though a few have formal training from religious institutions as well. The coverage by periods is comprehensive, from Lindberg on " Science and the Early Church" to Numbers on "The Creationists" and Keith Yandell (the philosopher) on "Protestant Theology and Natural Science in the Twentieth Century." The last title calls attention, however, to one oddity in the coverage. Whereas in the essays on the sixteenth through eighteenth centuries both Protestant and Catholic figures and movements are treated, in those on the nineteenth and twentieth centuries attention is focused almost exclusively on the Protestant scene. Clearly, eighteen substantial essays cannot be analyzed in detail in a review of reasonable length. I shall indicate the main topics and theses of each with a few comments where these can be made briefly. First, however, I should stress that the book is treasure-trove of information and ideas. All the essays are good; several are superb. Each should be highly instructive for readers who are not specialists in the topic and period it deals with... (shrink)

The debate over foundationalism, the viewpoint that there exists some secure foundation upon which to build a system of knowledge, appears to have been resolved and the antifoundationalists have at least temporarily prevailed. From a firmly historical approach, the book traces the foundationalism/antifoundationalism controversy in the work of many important figures Animaxander, Aristotle and Plato, Augustine, Descartes, Hegel and Nietzsche, Habermas and Chisholm, and others throughout the history of philosophy. The contributors, Joseph Margolis, Ronald Polansky, Gary Calore, Fred and (...) Emily Michael, William Wurzer, Charlene Haddock Siegfried, Sandra B. Rosenthal, Kathleen Wallace, and the editors present well the diversity, interest, and roots of antifoundationalism. The last decade has witnessed a particularly intensive debate over methodological issues in legal theory. The publication of Julie Dickson's Evaluation and Legal Theory (2001) was significant, as were collective returns to H.L.A. Hart's 'Postscript' to The Concept of Law. While influential articles have been written in disparate journals, no single collection of the most important papers exists. This volume - the first in a three volume series - aims not only to fill that gap but also propose a systematic (...) agenda for future work. The editors have selected articles written by leading legal theorists, including, among others, Leslie Green, Brian Leiter, Joseph Raz, Ronald Dworkin, and William Twining, and organized under four broad categories: 1) problems and purposes of legal theory; 2) the role of epistemology and semantics in theorising about the nature of law; 3) the relation between morality and legal theory; and 4) the scope of phenomena a general jurisprudence ought to address. Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both insightful (...) and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making. Second, at a minimum it points out serious pitfalls for analytical or empirical studies of juridical proof. (shrink)

Ethical Issues in Family Medicine addresses these problems, offering an ethics that reflects the distinctive features of family practice, and helping family physicians to appreciate the extent to which ethical issues influence their practice.

Every day we hear stories about the consequences of human frailties for individuals, their families, friends, and organizations. These involve alcohol and drug addiction and other harmful lifestyle choices, and all kinds of unethical and illegal behaviour, including bribery and corruption, price fixing, theft and fraud, sexual harassment and abuse of authority, fiddling expenses and cheating at sport and in exams. Efforts to teach ethical behaviour in business schools make little difference. The media who report others' frailties are themselves unethical (...) and engage in illegal conduct. This book places the spotlight on individuals, their behavioural choices and the consequences that follow for theirs and others' lives and careers. The conclusion is that people have real choices and options and that successful avoidance of the worst outcomes can be achieved where there is a proper sense of proportion, of what is important, and of how each of us is doing. Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers (...) a sustained and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. This book should be of interest to welfare economists, political scientists and decision-theorists. (shrink)

Theorists of human evolution are interested in understanding major shifts in human behavioural capacities (e.g. the creation of a novel technological industry, such as the Acheulean). This task faces empirical challenges arising both from the complexity of these events and the time-depths involved. However, we also confront issues of a more philosophical nature, such as how to best think about causation and explanation. This article considers such fundamental questions from the perspective of a prominent theory of causation in the philosophy (...) of science literature, namely, the interventionist theory of causation. A signature feature of this framework is its recognition of a family of distinct types of causes. We set out several of these causal notions and show how they can contribute to explaining transitions in human behavioural complexity. We do so, first, in a preliminary way, and then in a more detailed way, taking the origins of behavioural modernity as our extended case study. We conclude by suggesting some ways in which the approach developed here might be elaborated and extended. (shrink)

We revisit Naturalized Epistemology and the Law of Evidence, published twenty years ago. The evolution of the relative plausibility theory of juridical proof is offered as evidence of the advantage of a naturalized approach to the study of the field and law evidence. Various alternative explanations of aspects of juridical proof from other disciplines are examined and their shortcomings described. These competing explanations are similar in their reductive, a priori approaches that are at odds with an empirically oriented naturalized approach. (...) The shortcomings of the various a priori approaches are driven by their common methodological commitments to employing weird hypotheticals to engage in intuition mining about the American legal systems that in turn ignore important aspects of the actual legal systems and consistently make impossible epistemological demands. As a result, both their descriptions of and prescriptions for American legal systems are implausible, unlike the relative plausibility theory. (shrink)

This brief essay explores how understanding the treatment of expert evidence requires engaging with its legal and political contexts, and not just focusing on its epistemological aspects. Although the law of evidence and thus its treatment of experts is significantly informed by epistemological considerations, it is also informed by concerns over the organization of trials, larger issues of intelligent governance, social concerns, and enforcement issues. These five aspects to the law of evidence give rise to principles to guide the explicit (...) structuring of the law of evidence that are identified here as well. This complexity helps to explain why the central issue of expert testimony is not the epistemological one of knowledge and belief but instead the conflict between educational and deferential modes of trial.
